CMYK will give you the ability to select Write Layers, Preserve Text Editability, and Maximum Editability.

RGB tends to flatten the object component layers.

I noticed you exprted your AI to PSD in RGB.

YIKES.... and I don't have Illustrator loaded in my cpu at the moment so I can check.... lol.... Hope my memory serves me well tonite....

Your Illustrator Document Mode has to match the Color Mode in the export options. Your illustrator document must be set at RGB. Try changing it to CMYK....

CMYK is more flexible .

Do you have any effect or feature that would enforce flattening.?

Some combinations of clipping masks, raster effects and blending modes will do that because there is no way to retain the appearance during export.

Digging my mind for possible problems....

You got a small file, right? with maybe 4 or 5 layers? Try grouping them (not resterize) before you export.

Make sure there are no hidden, unneeded layers.

That's one thing about Illustrator to PS.... LAYERS EXPORT PROBLEM.

Thanks alot for taking the time to replay to me!
I convert the doc to CMYK and the layers are really small and grouped but still it export as flat image !!!

That doesn't look like a flat image. It's a layer with a transparent background. Is it without a white background like your first file?

And I notice you got MASKS.... sometimes even a single mask makes the export plugin do wierd things.

The image is from the first file open inside illustrator CS5.
The problem that this is not the only file I face this problem with. they are many!!
I think I will have to copy paste each layer. thanks for the idea :)

Your image is to basic to write layers that group would have been flattened in a larger vector file for such a basic document I have never been able to get illustrator to write the layers in a psd document.
Your option is to copy and paste each layer into ps

ps not sure if the above picture is yours or the 1 I remade.

I was able to. But that's the problem with Illustrator. After a while it acts up.

It's happened to me on some occasions but managed to figure it out. Either caused by a single layer or an effect.
