Problem with brushes/patterns

I am trying to figure out how to create such an effect : (the black effect) which can be found here : ww.marilyn-forever.com/images/header_bg.jpg

Is it using a brush? or a pattern? If anyone has a similar brush / pattern could you please tell me where I can get it?
